Gallagher & Kennedy was hired by the Arizona Attorney General's Office to lead the trial team in the State’s case against Choice Home Warranty, a company that was alleged to have used deceptive marketing practices in selling home warranties to Arizona residents. The case settled on the eve of a 2.5-month trial for $11.8 million and significant injunctive terms that protect Arizona residents from deceptive sales practices.
The settlement is believed to be the largest settlement in the United States for claims of this type. The complex case had been tenaciously litigated by the Attorney General's Office (including AGO consumer protection attorneys Mitchell Allee, Steve Silverman, Dylan Jones, and Suzanne Prendergast) for over six years and included thousands of exhibits, hundreds of witnesses, and cutting-edge legal issues.
