New Mexico Supreme Court Rules in Favor of Gallagher & Kennedy Client Freeport-McMoRan in “Copper Rule” Case

On March 8, 2018, the New Mexico Supreme Court affirmed the State Water Quality Control Commission’s adoption of regulations governing the steps that must be taken to protect groundwater at open pit copper mines.

The Court ruled unanimously that the regulations, known as the “Copper Rule,” were valid under the state’s Water Quality Act. Freeport-McMoRan intervened in the case to support the Copper Rule as adopted by the Commission.
