Judge Denies Request for Dismissal and Gives Green Light for Class Action Suit Filed in Arizona to Continue

On Wednesday, March 13, 2024, the United States District Court for the District of Arizona issued an order denying Defendant loanDepot.com, LLC’s motions to dismiss and to strike Plaintiff’s class action claims brought under the Telephone Consumer Protection Act (“TCPA”). loanDepot.com, LLC will now have to answer Plaintiff’s class action claims, which assert loanDepot.com placed thousands of unsolicited telemarketing calls or text messages in violation of the TCPA, including to Plaintiff, whose telephone number had been placed on the National Do-Not-Call Registry since at least 2007.
