Administrative & Regulatory

When your business operates in a regulated industry, there are important and complex issues required to achieve and maintain compliance. We advise corporations, trade associations, non-profits, and individuals before federal, state, and local governing bodies and governmental agencies in a variety of industries and legal issues, including environmental and natural resources, public bidding and procurement, public utilities, and workplace regulation.

ENVIRONMENTAL & NATURAL RESOURCES REGULATION & COMPLIANCE

Companies facing environmental and natural resources regulation need a legal team who understands not only the complex statutes and regulations in environmental litigation, but also the science associated with regulated substances such as heavy metals, mold, asbestos, benzene, pesticides, TCE, and PCBs. We represent local and national clients in federal and state rulemaking and enforcement proceedings, appeals, and permit and license hearings. These enforcement actions involve clients in all manufacturing sectors, with particular emphasis on:

  • Agriculture
  • Utility
  • Technology
  • Mining
  • Mineral Processing

Working regularly with independent technical experts, our environmental attorneys have formal training in geology, engineering, chemistry, hydrology, biology, and toxicology, arming them with the unique ability to translate highly technical concepts to lay jurors, judges, and arbitrators.

PUBLIC BIDDING & PROCUREMENT

Every government entity, from the federal government to states, counties, cities, and school districts, has its own laws and regulations concerning public bidding and procurement. This includes registration requirements, notification procedures, and timelines. These are more than just “technical” – and failing to comply with the specific procurement laws, processes, and guidelines could mean disqualification from an application.

We assist you in complying with the government’s complex requirements, allowing you to focus on preparing a competitive bid or proposal and meet your business objectives.

PUBLIC UTILITIES

Regularly appearing before the Arizona Corporation Commission, we represent clients in state ratemaking, rulemaking, acquisition, financing, resource planning, environmental compliance, and other regulatory proceedings. We have experience representing for-profit and not-for-profit electric, gas, water, and telecommunications utilities and utility-related organizations.

Our public utility advocacy practice is dedicated to improving the regulatory environment for our clients by encouraging regulators to streamline the regulatory process and implement efficiencies to oversee utility operations.

In New Mexico, our team has appeared before the New Mexico Public Regulation Commission to advocate for oil and gas and other environmental and natural resources entities in utility issues.

WORKPLACE REGULATION

Employers of all sizes and industries face federal and state workplace regulations. We represent and defend employers in administrative claims and civil litigation before federal and state regulatory agencies, and in private civil actions by current and former employees. For employers, we provide strategic risk management to comply with such matters as Fair Labor Standards Act (overtime and minimum wage law), Family & Medical Leave Act, and Worker Adjustment Retraining & Notification Act (plant closing statute).

We are committed to understanding your business’s specific challenges and creating solutions that meet your objectives. Often, we are working with you to prevent regulatory actions, but our experience will guide you in developing strategic responses to adverse regulatory actions should the need arise.

We’re here to help guide you through the myriad steps and processes to satisfy federal, state, and local regulatory requirements.
