Josefa Rodriguez brings a compassionate approach to helping families resolve domestic disputes involving legal separations, divorce proceedings, spousal maintenance, child custody and support, parental rights, and domestic violence. She is adept at achieving favorable resolutions through strategic advocacy and effective case management, with particular emphasis on settlement negotiations for early resolution and pre/post-nuptial agreements.

Josefa also helps bring families together through adoption and DCS Adoption matters.

Prior to joining Gallagher & Kennedy, Josefa gained extensive family law experience at another Valley law firm and as an Assistant Attorney General representing the Department of Child Safety in the Protective Services Section handling juvenile dependency matters. There, she learned the effectiveness of understanding and compassion to best assist families during the most difficult time of their lives.

A wife and mother herself, Josefa cherishes time with her family, whether it be running cornhole tournaments with her husband, participating in community fundraisers, or chasing after her toddler.

REPRESENTATIVE CASES

  • Obtained sole legal decision making and primary custody of minor children in a case that had a decade history of domestic violence within the home. Josefa and her team successfully presented the mother’s case, and in consideration of the hostile environment the father exposed the children to, and the children’s best interests, the Court awarded full custody to the mother and ensured the children’s safety.
  • Settled a child custody matter, obtaining equal parenting time for the father when the mother was actively preventing parenting time. Josefa and her team successfully settled the dispute without further court involvement, saving her client extensive costs of litigation and ensuring the child’s best interests.
  • Obtained primary custody of the minor children, and attorney fees and costs, for a wife during a contested divorce where the opposing party took unreasonable positions throughout the matter. In addition to the award of primary custody of the minor children to the mother, she was awarded $8,000 in past child support and $12,000 in attorney fees and costs.
  • Obtained emergency orders without notice for a father whose ex-spouse was suffering from mental health issues and exposing the minor children to an unsafe home environment.
  • Represented several families in their respective stepparent adoption and DCS Adoption matters.
