Gallagher & Kennedy’s remediation practice group of 12 environmental attorneys has helped industrial, mining, commercial and governmental clients manage potential liabilities and regulatory requirements associated with remediation sites in over 40 states and all ten EPA Regions. These sites involve impacts to soil, groundwater, sediments, surface water and indoor dust. We currently have a leading role representing clients at over 100 sites undergoing remediation under federal and state Superfund, voluntary cleanup or brownfield programs. At several of these sites, the firm’s environmental attorneys coordinate remediation activities with seeking cost recovery and defending personal injury, property damage or natural resource damage claims. This experience provides us with unique insights in integrating legal, policy, scientific, technical, stakeholder and community issues into an effective strategy for cost-effective site remediation and liability management.
The firm’s remediation practice group also has assisted clients in buying and selling over 500 contaminated properties. As part of these transactions, we have successfully addressed issues such as qualifying for liability protections, obtaining agency oversight and site closure, obtaining or pursuing insurance coverage, seeking cost recovery against prior owners or operators, and obtaining brownfields funding or other tax incentives for redevelopment.
