Health Care

Health care

Gallagher & Kennedy’s health care practice group assists clients in meeting the complex and ever-changing demands of one of the fastest growing and most highly regulated industries in the United States. Our attorneys are skilled in rendering sophisticated advice to a broad range of clients, from individual medical professionals, including those in alternative, complementary and integrative medicine, to larger health care entities and medical device manufacturers.

MEETING NEEDS WITH DIVERSE EXPERTISE
Our transactional health care practice provides legal and practical advice to health care professionals and other health care entities on the business aspects of their operations. Additionally, our attorneys are experienced and knowledgeable in regulatory compliance across the health care industry, and expertly assist our health care clients with general business regulations as well.

We guide clients through both routine and complex legal matters in their business operations, such as:

  • Providing advice and executing legal requirements to form new practices and other health care entities
  • Drafting shareholder, partnership and operating agreements to govern the relationship of the owners
  • Establishing joint venture and other collaborative arrangements
  • Negotiating and drafting a full range of contracts
  • Guiding clients through transitions, including the purchase or sale of a practice, new partner additions or separations, and entity dissolution

MANAGING BUSINESS AND PROFESSIONAL RISKS
In our health care litigation practice, Gallagher & Kennedy’s professional liability attorneys have substantial experience defending medical malpractice lawsuits and administrative proceedings, including licensing and credentialing, against medical professionals. Seeking to protect and defend their rights, our attorneys counsel and represent clients with respect to claims, potential claims, peer review processes and administrative actions to achieve the best possible results. Reaching successful outcomes for our clients in lieu of formal proceedings is always a priority. However, when a formal proceeding cannot be avoided, we possess the requisite experience, skill and knowledge to defend our clients, be it in court, in front of an administrative agency, licensing boards or other governing bodies.

In addition, our attorneys have substantial expertise in the area of professional claims investigations, and are highly skilled tacticians in the pursuit and defense of a wide variety of professional claims.
